Refund Policy

Prefab SmartLiving Homes: Return and Refund Policy

Effective Date Immediately

This Return and Refund Policy is incorporated by reference into our Terms of Service and governs all purchases made through Prefab SmartLiving Homes. By placing an order, submitting payment, or financing through a third-party provider, you agree to the conditions outlined below. This policy is part of and subject to our Terms of Service. In the event of a conflict, the Terms of Service shall prevail.

All homes are final sale and not eligible for return. See details below.

1. Final Sale Policy

All home sales are final, non-refundable, and non-cancellable. This applies to both custom-built and in-stock container homes, regardless of payment method (credit card, ACH, PayPal, Shop Pay, Enhancify financing, Preferred Funding or others).

We do not accept returns, refunds, cancellations, or chargebacks for any reason, including but not limited to:

  • Permit or zoning denials
  • Financing issues or delays
  • Change of use, location, or plans
  • Shipping delays beyond our control
  • Buyer's remorse or change in circumstances

The one and only exception to the refund policy is the $1,000 Design Deposit. Buyers will be allowed 5 days to receive a refund if they email Support@aprefabtinyhome.com within 5 days of paying the design deposit.

2. Custom-Built Units

All custom-built container homes are manufactured to your selected specifications. Therefore:

  • Non-returnable and non-refundable once production begins
  • No cancellations accepted after an order is placed
  • No exceptions due to inability to obtain local permits or HOA approval

If your unit cannot be delivered due to permit issues, we may offer to list it on our marketplace for resale. If successfully sold, we will remit payment to you, minus a 15% resale commission. This resale option is discretionary, not guaranteed, and does not create an obligation to find a buyer within any set timeframe.

3. Damage During Transit

If your unit is damaged in transit:

  • Minor issues will be resolved through free replacement parts under warranty
  • Significant structural damage (as determined by us) may qualify for partial refunds or other remedies, assessed on a case-by-case basis

Claims must be submitted within 3 calendar days of delivery and include complete photo or video documentation.

The presence of shipping damage does not alter the terms of sale or entitle the customer to cancel or return the unit unless expressly required by applicable law.

4. Warranty and Support

Your home is protected by comprehensive warranty coverage:

  • 1-Year Structural Warranty
  • If you obtain our Extended Warranty, the warranty will increase to a 10-Year Structural Warranty
  • 7-Year Home Systems Warranty (plumbing, HVAC, electrical)
  • 7-Year Appliance Warranty (e.g., water heater)

These warranties are administered through HomeCare Plus, an independent third-party provider. For full warranty terms or to initiate a claim, visit hcpwarranty.com.

Covered:

  • Manufacturing defects in structure, systems, and appliances
  • Select serviceable components such as doors, handles, fixtures
  • Failures due to normal use and covered components

Not Covered:

  • Damage from improper installation or unauthorized modifications
  • Failure to perform routine maintenance
  • Acts of God (flooding, hurricane, etc.)
  • Items explicitly excluded by HomeCare Plus' warranty terms

Our Additional Support:

In addition to the formal warranty, Prefab SmartLiving Homes may provide free replacement parts for certain issues (e.g., sink faucet, door handle, water heater parts) at our discretion. Shipping charges may apply.

Important: Warranty claims do not entitle customers to refunds or cancellations. Remedies are limited to part replacement or repair as specified in the warranty program.

5. Financing Agreements

Orders financed through a third party (e.g., Enhancify) are subject to the same no-refund, no-cancellation, and no-chargeback terms. Your payment method does not alter these obligations.

6. Delivery and Delays

Estimated delivery timelines:

Custom-built units: 30-90 business days

These are estimates only and may vary. We are not liable for delays caused by:

  • Port congestion or customs
  • Acts of God (e.g., storms, fires, etc.)
  • Trade-related rerouting
  • Force majeure events

Delays do not entitle you to refunds, cancellations, or chargebacks.

7. Acknowledgment and Consent

By placing an order, submitting payment, or accepting financing, you:

  • Affirm your full understanding and agreement with this Return and Refund Policy
  • Waive all rights to initiate chargebacks, reversals, or post-payment cancellations
  • Acknowledge sole responsibility for securing all necessary permits, zoning approvals, and utility setups
  • Agree that your remedy is limited to warranty repair or part replacement only

You agree that your sole and exclusive remedies are those expressly provided herein, and you waive all other implied or statutory refund rights to the fullest extent permitted by law.

8. Dispute Resolution

All disputes arising from this policy are subject to the dispute resolution provisions found in our Terms of Service including binding arbitration in the State of Delaware.
