1. Agreement to Terms

By accessing or using this website, or by purchasing any product or service from Prefab SmartLiving Homes (we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our site or services. By checking the Terms of Service agreement box at checkout or by submitting payment, you affirm that you understand and accept these Terms in full.

2. Products, Custom Orders, and Services

We manufacture and sell custom-built prefabricated homes, container homes, and modular units. All products are made to order. Product descriptions, specifications, pricing, and availability are subject to change without notice.

3. Ordering, Deposits & Payment Terms

To initiate production, a non-refundable deposit or full payment must be received. All orders are considered final and non-cancellable once
placed. No exceptions.

  • Remaining balances and shipping charges must be paid prior to final delivery.
  • Orders placed through third-party financing (e.g., Enhancify) remain subject to these Terms, including finality and non-refundability.
  • Payment constitutes agreement to these terms and a waiver of any future chargebacks or reversals.

4. No Refunds, Returns, or Chargebacks

ALL SALES ARE FINAL.
Due to the made-to-order nature of our products:

  • No cancellations, refunds, returns, or chargebacks are permitted under any circumstances.
  • This policy applies even if permits or approvals cannot be obtained, or if delivery/installation is delayed due to site issues.
  • You agree not to initiate chargebacks or disputes with credit card providers, PayPal, or other processors.

Exception:
If your unit cannot be delivered due to permit or zoning issues, we may agree to assist in reselling the unit on our marketplace, subject to a 15%
commission fee. Funds from resale are disbursed only after the unit is successfully resold.

5. Site Readiness, Permits, and Local Requirements

Customers are fully and solely responsible for:

  • Obtaining all necessary permits, HOA approvals, or utility access before purchasing
  • Ensuring site readiness, including grading, foundations, access roads, and hookups
  • Complying with all local, county, and state building codes and regulations

Prefab SmartLiving Homes assumes no responsibility for permitting, zoning compliance, or utility access. Permit denial does not entitle you to a
refund.

6. Tariffs, Import Duties, and International Compliance

You are responsible for any additional charges that may arise due to:

  • Changes in tariffs (e.g., Section 301, steel tariffs)
  • International shipping duties, customs charges, or trade surcharges
  • HS Code adjustments (typically 940690)

If these costs increase after your order, you remain liable for the additional balance. We reserve the right to adjust routing, delivery timeline, or
import strategy to mitigate tariffs or optimize delivery—at our discretion.

7. Production Timeline and Delivery

Production timelines vary and are estimates only. Shipping or routing delays do not entitle customers to cancellations or refunds.

  • We reserve the right to reroute, delay, or restructure logistics to optimize for trade policy, customer location, or operational efficiency.

8. Warranties

Each home includes up to:

  • 1 Year Structural Warranty
Warranties cover manufacturer defects only and do not apply to damage caused by misuse, neglect, modification, or failure to maintain the unit.

9. Customer Conduct & Acceptable Use

Use of our website or content must be lawful and ethical. You may not:

  • Scrape, reverse engineer, or misuse our digital content
  • Impersonate our business or misrepresent offerings
  • Resell or reuse our trademarks, content, or materials without written consent

Warranties cover manufacturer defects only and do not apply to damage caused by misuse, neglect, modification, or failure to maintain the
unit.

10. Intellectual Property

All website content, product images, designs, logos, and digital assets belong to Prefab SmartLiving Homes and may not be used without express written permission.

11. Dispute Resolution

In the event of a dispute:

  1. Please first contact our Customer Care team at support
  2. If the issue is unresolved, you agree to submit to binding arbitration under the rules of the American Arbitration Association (AAA).
  3. Arbitration will take place in Delaware, and both parties waive the right to bring a class action.

12. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.

13. Amendments

We may update or modify these Terms at any time. Any changes will be posted. Continued use of our site or services after updates constitutes acceptance of these terms.

14. Final Agreement Confirmation

By completing a purchase, submitting a deposit, or clicking "I agree" during checkout, you:

  • Confirm you understand and accept all terms above
  • Waive your right to cancel, return, or dispute the transaction
  • Acknowledge that you are solely responsible for permits, site readiness, and compliance

All homes are final sale and not eligible

We may update these terms from time to time. Any changes will be posted on our website, and your continued use of our services constitutes acceptance
